PREAMBLE

These General Terms and Conditions of Sale and Use (hereinafter referred to as the "GTCU") govern all use of the online ticketing services of the company LA MAISON DES HISTOIRES accessible from the website www.lamaisondeshistoires.com (hereinafter referred to as "the Site").
The Site offers the purchase of tickets giving access to LA MAISON DES HISTOIRES, a children's play museum located at 11 rue de Sèvres, 75006 Paris, according to various offers and terms.
All Customers acknowledge that they are legally capable.
The Customer declares and acknowledges that he/she has read and accepted without reservation the entirety of these GTCU.

 

ARTICLE 1: DEFINITIONS
"Customer": refers to any person who has registered on the Site and ordered one or more tickets for LA MAISON DES HISTOIRES.
"Order": refers to any purchase of a ticket made on the Site by a Customer.
"Customer Account": refers to the account created by a Customer on the Site prior to placing an Order.

"Tickets": refers to tickets for access to La Maison sold on the Site.


ARTICLE 2: REGISTRATION
In order to place an Order, all Customers must register and create a Customer Account on the Site, by completing all mandatory fields and validating the present GTCU.
All Customers guarantee to LA MAISON DES HISTOIRES the truthfulness and accuracy of the information provided when creating their Customer Account and during the Order process. Consequently, LA MAISON DES HISTOIRES cannot be held responsible for the inaccuracy or irrelevance of the data and information provided by the Customer. In the event of any change to such data or information, the Customer undertakes to notify LA MAISON DES HISTOIRES as soon as possible.
In addition, all Customers are solely responsible for their personal identifier and password, and undertake not to divulge them.
Should a Customer Account be used by an unauthorized third party, the Customer concerned undertakes to inform LA MAISON DES HISTOIRES immediately, who will then do its utmost to take the appropriate measures.

 

ARTICLE 3: ORDERING PROCESS

The company LA MAISON DES HISTOIRES reserves the right to refuse any Order from an identified Customer with whom there is a dispute relating to a previous Order.
The company LA MAISON DES HISTOIRES also reserves the right to refuse any Order involving an abnormal quantity of tickets.

The Order steps are :
1) Selection of the type of visit, date and time slot required, and creation of a basket;
2) Summary, possible selection of another ticket and/or deletion of a ticket already in the basket, validation of the basket;
3) Login or creation of a Customer Account;
4) Summary of the Order, with information on the essential characteristics of the ticket chosen;
5) Payment of the Order, with details of the payment methods accepted;
6) Sending of a confirmation e-mail containing the information given in the Order summary, payment details, and contact details for LA MAISON DES HISTOIRES (contact e-mail, telephone number). This confirmation email materializes the conclusion of the contract. The confirmation email will be sent to the Customer immediately after payment has been accepted.
7) Payment receipt sent by email by the payment service provider linked to the store (Stripe)

 

ARTICLE 4: PRICES AND METHODS OF PAYMENT
Ticket prices displayed on the Site are quoted in euros and include all taxes.
Any change in VAT will be automatically and immediately reflected in the price of subscriptions. The same will apply in the event of the introduction of a new compulsory tax.
The company LA MAISON DES HISTOIRES may modify the prices of the tickets it offers on its Site at any time.
However, tickets are always invoiced on the basis of the prices indicated by the company LA MAISON DES HISTOIRES during the Order summary and in the Order confirmation e-mail.
Payment is made on the Site exclusively by credit card. Payment for the order is made in a single payment. Only the following methods of payment are accepted: CB, Visa, Mastercard, Google Pay.
When paying by credit card, the Customer is invited to enter his/her bank details via a secure https protocol.
LA MAISON DES HISTOIRES guarantees the reliability of transactions, as the Customer's bank details are encrypted as soon as they are entered.
LA MAISON DES HISTOIRES does not hold the Customer's bank details at any time, as they are solely and temporarily held by the payment service provider.

 

ARTICLE 5: TICKET RESERVATIONS AND ACCESS TO LA MAISON DES HISTOIRES

Reservations on La Maison des histoires website are accessible 24/7, and provide an immediate answer on availability.

Tickets are sent by e-mail by the ticketing service provider linked to the store (ticket tailor).

The barcode on the ticket will be scanned when you enter La Maison des histoires.
Reproduction, falsification or duplication of a ticket is strictly forbidden.

Access to La Maison des histoires is via the Chantelivre bookshop (hut at the back of the bookshop during opening hours, or meet in front of the bookshop outside opening hours).

La Maison des histoires is a place dedicated to families and children. Children must always be accompanied by an adult, for whom they remain responsible. Children of all ages must have a ticket to enter La Maison des histoires.

 

ARTICLE 6: SOLIDARITY TICKETING

La Maison des histoires has organized a solidarity collection on its ticketing system to contribute to its accessibility and the diversity of its audiences. This first collection took place between 09/06/23 and 31/07/24, at a rate of €1 per ticket sold, excluding school tickets. It will enable la Maison des histoires to welcome around 1,000 visitors a year free of charge over the years 2023-2024 and 2024-2025: children and adults who are far from books, coming via REP or REP+ school groups or partner associations.


The money raised is set aside and used to finance these tickets. These are charged at the same rate as individual tickets (12€ child / 9€ adult). The cost of a group is estimated at 250€ (group calculation formula = average number of children 25x12€ + average number of adults 4x9€).


This amount will be updated, if necessary, according to changes in the admission price. This amount will be deducted for each group.

ARTICLE 7: IMAGE RIGHTS

By confirming the purchase of admission tickets to La Maison des histoires, visitors understand that their face and/or those of their child(ren) may appear on the social networks of other visitors and acknowledge that La Maison des histoires will not be held responsible in any way.

 

La Maison des histoires undertakes to publish only temporary "story" formats on its social networks. Post-permanent photos will be posted only with the visitor's explicit consent.

ARTICLE 8: CANCELLATION, EXCHANGE AND REFUND CONDITIONS

La Maison des histoires accepts ticket cancellations under the following conditions:

- Up to 48 hours in advance: order refunded free of charge. To exchange tickets, you must cancel your order and buy tickets again on the chosen date.

- Less than 48 hours in advance: refunds or postponements are no longer possible. It is nevertheless possible to offer or resell a ticket, subject to compliance with the penal code. The resale of a ticket at a price higher than that shown on the ticket is strictly forbidden, subject to the penalties laid down in the French penal code (law of June 27, 1919).

Clothing and stationery returns and exchanges

With regard to clothing, the Vendor does not accept refunds for products purchased, except in the case of lack of conformity or hidden defect. However, the Buyer has a period of 15 days from the date of purchase of the products to return them for exchange, upon presentation of proof of payment. This exchange can only be made at la Maison des histoires (13 rue de Sèvres, 75006, Paris) and cannot under any circumstances be made by delivery/mail. Products must be returned in their original condition and complete (packaging, accessories, instructions, etc.), with the label still attached and unworn (excluding fittings) to enable them to be remarketed in new condition. Damaged, soiled, worn or incomplete products will not be accepted.

With regard to stationery, the Vendor does not accept refunds or exchanges of purchased products, except in the case of lack of conformity or hidden defect.

ARTICLE 8: INTELLECTUAL PROPERTY
All elements making up the Site (texts, videos, sound recordings, comments, trademarks, trade name, domain name, drawings, images, graphic charter, logos, photos, database, etc.) are strictly protected by intellectual property law and are the exclusive property of LA MAISON DES HISTOIRES and/or its commercial partners.
Any total or partial reproduction or representation of the Site and/or of one or more of its elements is strictly forbidden without prior written authorization from LA MAISON DES HISTOIRES.

ARTICLE 9: PERSONAL DATA

LA MAISON DES HISTOIRES undertakes to comply with European regulations on the processing of Personal Data (the European General Regulation on the Protection of Personal Data n°2016/679, known as "RGPD", of April 27, 2016) as well as regulations applicable in France.

 

Customers are informed that LA MAISON DES HISTOIRES collects and processes some of their personal data. As indicated on the Account creation form, certain data must be provided, while others are optional.

 

In addition, all Customers are informed that LA MAISON DES HISTOIRES automatically receives and records information from their computer and browser, including their IP address, when they connect to the Site.

 

Customers' personal data is kept only for the period corresponding to the purpose for which it was collected, which in any case may not exceed 3 years.

 On the other hand, accounting and tax data may be kept for a period of ten years in accordance with applicable regulations.

 Customers' personal data may be used :

  • To manage, process, fulfill and pay for customer orders (delivery, invoicing, after-sales service);
  • In order to comply with the legal and regulatory obligations imposed on LA MAISON DES HISTOIRES, particularly in terms of archiving electronic contracts concluded via the Site;
  • For advertising purposes, either after obtaining the express consent of Customers, in particular when subscribing to the LA MAISON DES HISTOIRES newsletter, or within the limits authorized by law and, in particular, by article 34-5 of the French Post and Electronic Communications Code;
  • For security purposes and, in particular, to detect and prevent fraud, spam, abuse, security incidents and other harmful activities.

LA MAISON DES HISTOIRES remains the sole owner of the personal information and data collected on the Site, which will not be sold, exchanged, transferred, or given to another company for commercial purposes, without the express consent of Customers.

 Customers' personal data may only be disclosed in application of a law, regulation or court order.

On the other hand, anonymized and/or aggregated data, i.e. data that does not allow customers to be identified, may be supplied to third parties, particularly for statistical purposes.

 If all or part of the Site is acquired by a third party, the personal data in LA MAISON DES HISTOIRES 's possession will, where appropriate, be transferred to the new owner. In this case, LA MAISON DES HISTOIRES will inform Customers by the most appropriate means before their personal data is transferred and is governed by another Personal Data Protection Policy. LA MAISON DES HISTOIRES will inform Customers of the options available to them in this case.

 When LA MAISON DES HISTOIRES uses a service provider or subcontractor to collect and process customer personal data, for example to manage Customer Accounts or process Orders, LA MAISON DES HISTOIRES must first ensure that the service provider or subcontractor provides adequate guarantees in terms of confidentiality, use and data protection.

 

In any event, LA MAISON DES HISTOIRES implements a variety of security measures to preserve the integrity of personal data collected on the Site.

 Only LA MAISON DES HISTOIRES employees who need to perform a specific job (for example, billing or customer service) have access to personally identifiable information. Computers and servers used to store personally identifiable information are kept in a secure environment.

 All customers have the right to access, rectify, delete, oppose and port their personal data, as well as the right to limit their processing.

LA MAISON DES HISTOIRES will endeavor to respond to all requests concerning the above-mentioned rights within a maximum of one (1) month.

 

However, and in accordance with the provisions of Article 12.3 of the RGPD, this deadline may be extended by a maximum of two months for reasons relating to the complexity and number of requests that LA MAISON DES HISTOIRES will have to process. In this case, the Customer will be notified of the extension of the response time within one month of receipt of the request.

Any customer who no longer wishes to receive newsletters or commercial prospecting by e-mail may indicate this to LA MAISON DES HISTOIRES at any time by clicking on the unsubscribe link included in every e-mail sent to them.

 

If a customer believes that LA MAISON DES HISTOIRES is not complying with its obligations with regard to the collection and processing of personal data, it may submit a complaint to the CNIL by mail or electronically through the following link: https: //www.cnil.fr/fr/plaintes/internet

 

ARTICLE 10: COOKIES

LA MAISON DES HISTOIRES uses cookies and similar technologies in order to offer customers a personalized and secure service and to guarantee optimized and personalized browsing on the Site.

 

The term "cookie" covers the various tracers that are deposited or read on customers' terminals when they browse web pages. Cookies are used on the Site for various purposes, mainly to facilitate browsing, to offer personalized content and advertising, and to compile visit statistics.

 The information collected by means of cookies does not under any circumstances enable a Customer to be identified either directly or indirectly, and is solely intended to help LA MAISON DES HISTOIRES improve the performance of the Site. These may include analytical cookies, such as audience measurement cookies, advertising cookies or social network sharing cookies.

ARTICLE 11: PROOF AGREEMENT
The written document in electronic form shall be admissible as proof of the rights and/or obligations of the parties to these GCSU.
The computerized registers, kept in the computer systems of the company LA MAISON DES HISTOIRES under reasonable conditions of security, shall be considered as proof of the communications, Orders and payments that have taken place between the parties.

ARTICLE 12: PARTIAL NULLITY
If one or more clauses of these GCUV are held to be invalid pursuant to a law, regulation or court decision, the other clauses will retain their full force and scope.

 

ARTICLE 13: MODIFICATION OF TERMS AND CONDITIONS
LA MAISON DES HISTOIRES reserves the right to modify these terms and conditions at any time, in whole or in part. All Customers are deemed to accept the current version of the GCUU each time they connect to the Site.

Non-professional customers are informed that, in accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, LA MAISON DES HISTOIRES subscribes to the services of the CMAP (Centre de Médiation et d'Arbitrage de Paris).

When a customer's prior written complaint has been unsuccessful, the Mediation Service can be contacted for any consumer dispute.
